But to benefit from the Federal Tax Authority's waiver of the late corporate tax registration penalty, the first Tax Return or Annual Declaration must be submitted within seven months from the end of the first Tax Period. Filing at seven months rather than nine is what triggers the waiver, and a penalty already paid is refunded to the taxable person's account.

Two deadlines apply to a first corporate tax return, and they are two months apart. Most businesses know the nine-month one. The seven-month one is the one with money attached.

The Federal Tax Authority's waiver of the late corporate tax registration penalty is conditional on filing the first return early — within seven months of the end of the first tax period, not the usual nine. A business that registered late, then files comfortably inside the normal deadline, will have missed the waiver by filing on time.

The condition, stated precisely

The Federal Tax Authority requires that taxable persons submit their Tax Return, or Annual Declaration, within a period not exceeding seven months from the end of their first Tax Period or first Financial Year. The window runs from the end of the first tax period specifically — not from any subsequent one.

The waiver covers the administrative penalty for failing to submit a corporate tax registration application within the specified deadline. It reaches businesses that registered late and were penalised, and businesses that had not registered at all.

If you have already paid the penalty

Payment does not put the waiver out of reach. The Federal Tax Authority states that where a taxable person has paid the administrative penalty for late submission of the registration application and meets the conditions, the paid penalty is refunded and credited to the taxable person's account.

So a business that paid the penalty months ago, assuming the matter closed, may still recover it by filing its first return inside the seven-month window. That is worth checking before the window closes rather than after.

You still have to file — the waiver is not automatic in the sense people assume

There is no separate waiver application, reconsideration request or form to submit. In that narrow sense it is automatic. But it is not automatic in the sense of arriving without action: the filing itself is the qualifying act, and if the return is not submitted inside seven months there is nothing to apply the waiver to.

This distinction matters because 'automatic waiver' is how the initiative is often summarised, and it is the kind of phrasing that leads a business to wait.

Working out your own date

The seven months run from the end of your first tax period, which depends on your financial year rather than on any national calendar date. There is no single deadline that applies to everyone, which is exactly why the rule gets missed.

  • Identify the end date of your first tax period, not the current one
  • Add seven months — that is the waiver date
  • Add nine months — that is the ordinary filing and payment deadline
  • If the first date has passed and the second has not, filing quickly no longer recovers the waiver, but it does limit further exposure
  • Filing and payment are a single obligation: the return alone does not discharge it
